Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a) Freight Elevator, on or about 4/3/07: Hoistway second floor landing area gate interlocking device was missing from one side of the hoistway opening. b) Freight Elevator, on or about 4/3/07: Car controls (handropes) were not labeled as to direction of car travel and stopping of the car. c) Freight Elevator, on or about 4/3/07: Company did not have a formalized training program for those employees designated as elevator operators. ABATEMENT NOTE: One means of abatement for item (a) would be to ensure that prevent the opening of the gate unless the car floor is at or near the landing per American Society of Mechanical Engineers, ASME A17-1, 1921, Section 12, Rule 121(k). ABATEMENT NOTE: One means of abatement for item (b) would be to ensure that car controls are labeled for direction of travel per American Society of Mechanical Engineers, ASME A17-1, 1921, Section 32, Rule 324(o). ABATEMENT NOTE: One means of abatement for item (c) would be to incorporate the training requirements of American Society of Mechanical Engineers, ASME17.1, 1921, Section 71, Rule 710(a) and (b) and Rule 711(b).
