Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer does not
furnish employment and a place of employment which are free from
recognized hazards that are
causing or likely to cause death or serious physical harm to employees in
that employees are
operating equipment with defects that are not being repaired which exposes
employees to
possible crushing injuries and broken bones. A recent example occurred on
October 30, 2008.
(a)Yard Area - The Caterpillar 928G front end loader has defects which are
not
immediately corrected and the loader remains in service.  Defects include
items,
such as a cracked windshield, broken lights, hydraulic leaks, wipers that
do not
work, power loss when digging out and a broken seat as documented on the
employer's Powered Industrial Vehicle (PIV) Pre-Operation Checklist.
Pursuant to 29 C.F.R. 1903.19, the employer must submit documents
describing the
steps it is taking to ensure correction of the specific instance described
above.
The employer has an ongoing obligation to ensure prompt reporting and
repair of
defective equipment in accordance to the manufacturer's recommendations.
The specific
instance described above will be abated by March 4, 2009.
