Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment
and a place of employment which were free from recognized hazards that
were causing or likely to cause death
or serious physical harm to employees in that employees were exposed to
the hazard of being struck by motor
vehicles while working on public streets:
(a) Located at the corner and work site of 8025 James A. Reed Road,
Raytown, Missouri on October  24, 2007,
the employer did not ensure that employees performing powerline tree
trimming and ground clean-up operations
on the ground and in a lifted bucket from a bucket truck were exposed to
being struck by motor vehicles in that
warning signs were not posted for northbound traffic and (b) at the corner
and work site of 8025 James A. Reed
Road, Raytown, Missouri on October  24, 2007 the employer did not ensure
that employees working on the ground
and in a lifted bucket from a bucket truck were exposed to being struck by
motor vehicles in that tree trimming and
bucket truck activities created the lane closure of the northbound
two-lane through road having a posted speed limit
of 35 mph and provisions were not made for alternate one-way movement
through the constricted section.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS
HAZARD IS:
(a) provide warning signs in all directions through the constricted area
and (b) provide alternate one-way movement
through the constricted section via methods such as flagger control or
stop or yield control and as outlined in (1)
the required guidelines of the Missouri Department of Transportation for
Work Zone safety, and  2. following the
guidelines of the 2003 Edition with Revision of the 2003MUTCD, Manual on
Uniform Traffic Control Devices and
Title 23 United States Code, 655 Section 109(d) and 23 CFR 655.603, and as
approved as the national standard for
designing, applying, and planning traffic control devices. Traffic plans
for handling traffic and pedestrians in Work
Zones and for the protection of workers shall conform to the requirements
of 23 CFR part 630, subpart J, Traffic
Safety in Highway and Street Work Zones which requires the use of warning
signs,  barricades, and alternate one-way traffic control methods through
constricted road sections.
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the above violation is
complete.
