Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Sewer Pipes Installation, 815 Mid Broadwell Road, Milton, Georgia, on or about April 3, 2008: An employee was riding inside the bucket of a tracked excavator as a means of exiting the approximately 7-feet 3-inch deep trench. Among other methods, one feasible and acceptable abatement method to correct the hazard is to prohibit the employees from riding on the excavator or in its attachments. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED
