KRS 338.031(1)(a): The employer did not furnish to his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to his employees: a.The employer did not require the use of an operator restraint system when equipped on their Hyster powered industrial trucks. Employees would be exposed to the hazard of being crushed in the event of a roll over. One feasible means of abatement would be for the employer to enforce the use of the seatbelt equipment currently installed on the companys powered industrial trucks.
