Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to blunt force trauma from a ruptured pressure vessel:
a)Foundry Department: Pressure Vessel # 3 ruptured due to over
pressurization of
the vessel. The vessel lacked the required identification information or
name
plate, the pressure relief devices were inoperative, and welded repairs to
the
vessel were not performed by an entity possessing a National Board repair
authorization or New Jersey repair authorization, on or about 1/15/2008.
ABATEMENT NOTE: Among other methods, feasible and acceptable means of
abatement to
correct this hazard include, but not limited to the following:
-  American Petroleum Institute (API) 510, 8th Edition, Addendum #4,
August 2003,
Section 6 -  Inspection and Testing of Pressure Vessels and Pressure
Relieving Devices -
6.1 - To ensure vessel integrity, all pressure vessels and
pressure-relieving devices shall
be inspected at the intervals/frequencies provided in this section.

Section 6 - Inspection and Testing of Pressure Vessels and Pressure
Relieving Devices
Section: 6.7 - Records - Pressure vessel owners and users shall maintain
permanent and
progressive records of their pressure vessels.  Permanent records will be
maintained
throughout the service life of each equipment item; progressive records
will be regularly
updated to include new information pertinent to the operation, inspection,
and
maintenance history of the equipment.

Section 7 - Repairs, Alterations, and Rerating of Pressure Vessels: 7.1-
General - When
repairs or alterations have to be performed, the applicable requirements
of the ASME
Code, the codes to which the vessels were built, or other specific
pressure vessel rating
codes shall be followed.  Before any repairs or alterations are performed,
all proposed
methods of execution, all materials, and all welding procedures that are
to
be used must
be approved by the authorized pressure vessel inspector and, if necessary,
by a pressure
vessel engineer experienced in pressure vessel design, fabrication, or
inspection.
