Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by hazards: due to the possible overloading of hoist and/or loads being dropped due to the absence of rated loads for "Below The Hook Lifting Devices" not having been conspicuously displayed on the device(s) (a)Durant, MS. - Throughout the plant- On or about February 20, 2008 "Below The Hook Lifting Devices were being used that have not been rated or marked for such use. Among other methods, one feasible and acceptable abatement method to correct this hazard is to; only use those devices which meet good engineering design, construction, and inspection. Consult and adhere to those requirements written in ANSI/ASME B30.20, "Below The Hook Lifting Devices".
