Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard or a dust explosion and fire in the headhouse when the employer failed to inspect and service their suppression system in the #1 Bucket Elevator per recommendation of the manufacturer. a)Headhouse - There was a Fenwal designed X-Pac suppression system located in the #1 Bucket Elevator that was not inspected and serviced in its entirety. (i.e. X-Pac 1H1) on a quarterly basis as recommended by the manufacturer. Among other feasible methods to correct the identified hazard, one method would be to conduct inspections and maintenance as recommended per NFPA 69 "Explosion Prevention Systems", Chapter 15 Installation Inspection, and Maintenance of Explosion Prevention Systems".
