Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were likely to cause death or serious physical harm to employees, in that an employee was exposed to injury from unintended actuation of a foot pedal not provided with a guard: a. Buckeye Diamond Logistics, Inc. On or about March 12, 2008, at 3180 Fort Shawnee Industrial Boulevard, Lima, Ohio: An employee was exposed to the hazard of being crushed by an ECOA hydraulic lift table, model HL12-025-36-24048, serial number 870418-3, and the operators foot pedal was not guarded against inadvertent operation by a guard over the pedal. On the evening of March 10, 2008 the employee received crushing injuries when he reached under the lift table and the pedal was inadvertently actuated by another employee. One feasible means of abatement is to install a guard over the pedals to prevent unintended operation. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
