Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees, in that the dust
collector for the Hay Room baling machine was not located outside of the
building, and was not
equipped with deflagration detection and suppression systems.  The dust
collector for the Bay
#2 baling machine was not equipped with deflagration detection and
suppression systems:
a.Vitakraft Sunseed, Inc. located in Weston, Ohio:  On or about August 6,
2008, the
employer did not ensure the dust collector for the Hay Room baler machine
was located
outside of the building, provided with a fire suppression system, provided
with explosion
relief venting, and provided with explosion isolation devices to prevent
deflagration
propagation from the dust collector to the upstream work area.  The
alfalfa dust entering
the dust collector had a kst value of 7.48 bm/s and is classified as an
explosive dust.
b.Vitakraft Sunseed, Inc. located in Weston, Ohio:  On or about August 6,
2008, the
employer did not ensure the dust collector for the Bay #2 baler machine
was provided
with explosion relief venting, was provided with a fire suppression
system, and was
provided with explosion isolation devices to prevent deflagration
propagation from the
dust collector to the upstream work area.  The alfalfa dust entering the
dust collector had
a kst value of 35.49 bm/s and is classified as an explosive dust.
ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement
method
to correct this hazard is to comply with National Fire Protection Agency
(NFPA) 61 "Prevention
of Fires and Dust Explosions in Agricultural and Food Processing
Facilities" (2008); NFPA 68
"Standard on Explosion Protection by Deflagration Venting" (2007); NFPA 69
"Standard on
Explosion Prevention Systems" (2008), including, but not limited to: a)
install a deflagration
detection and suppression system in accordance with Chapter 8 of NFPA 69.
b) install devices
and systems that vent combustion gases, materials and pressures outside to
a safe location in
accordance with NFPA 68, c) relocate all dust collection equipment to an
outside location in
accordance with NFPA 61.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence of abatement,
or other written
records.t,

were exposed to fire and explosion hazards due to the generation of
explosive alfalfa dust during
cleaning operations in the Hay Room:
a.Vitakraft Sunseed, Inc. located in Weston, Ohio:  On or about August 6,
2008, the
employer did not ensure employees, working in the Hay Room, using
compressed air to
remove alfalfa dust from room surfaces, ensured that precautions were
taken to eliminate
ignition sources.  The alfalfa dust captured by the dust collector had a
kst value of 7.48
bm/s and is classified as an explosive dust.
ABATEMENT NOTE: Among other methods, one feasible and acceptable method to
correct
this hazard is to ensure employees minimize the generation of dust in
accordance with National
Fire Protection Agency (NFPA) 61 "Prevention of Fires and Dust Explosions
in Agricultural and
Food Processing Facilities" (2008).
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
