Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were likely to cause death or serious physical harm to employees in that
under the hook lifting
devices did not include marked capacities, exposing employees to
struck/crush by injuries if the
lifting devices were to fail:
a)  Cooper Tire & Rubber Co. - Findlay, Ohio:  On or about April 22, 2009,
employees were
exposed to struck/crush-by injuries in that the employer did not mark the
capacity on the under
the hook lifting devices which are detachable from the marked Caldwell
spreader bar (s/n
99748/04371).  The lifting devices are used in conjunction with an
underhung Budgit three ton
hoist to lift and maneuver product/calendar rolls into the Fischer #1
machine located in Dept.
107.
b)  Cooper Tire & Rubber Co. - Findlay, Ohio:  On or about April 22, 2009,
employees were
exposed to struck/crush-by injuries in that the employer did not mark the
capacity on the under
the hook lifting devices that are detachable from the marked Caldwell
spreader bar (s/n 08332).
The lifting devices are used in conjunction with an underhung CM three ton
hoist to lift and
maneuver product/calendar rolls into the Fischer #2 machine located in
Dept. 107.
c)  Cooper Tire & Rubber Co. - Findlay, Ohio:  On or about April 22, 2009,
employees were
exposed to struck/crush-by injuries in that the employer did not mark the
capacity on the under
the hook lifting devices that are detachable from the marked Caldwell
spreader bar.  The lifting
devices are used in conjunction with an underhung CM three ton hoist (s/n
L-1021RC) to lift
and maneuver product/calendar rolls into the VMI belt cutter machine
located in Dept. 107.
d)  Cooper Tire & Rubber Co. - Findlay, Ohio:  On or about April 22, 2009,
employees
were
exposed to struck/crush-by injuries in that the employer did not mark the
capacity on the under
the hook lifting devices that are detachable from the marked Caldwell
spreader bar (s/n 06-
69009-1).  The lifting devices are used in conjunction with a CM three ton
hoist to lift and
maneuver product/calendar rolls into the #5 Bias machine located in Dept.
107.
Among other methods, one feasible and acceptable method to correct this
hazard is to
follow ASME B30.20-2006: Below the Hook Lifting Devices.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in
addition, documentation demonstrating that abatement is complete must be
included with
your certification.  This documentation may include, but is not limited
to, evidence of the
purchase or repair of the equipment, photographic or video evidence of
abatement, or other
written records.

employees were exposed to
struck/crush-by injuries in that lifting devices and/or load could be
dislodged from the hoist
hook:
a)  Cooper Tire & Rubber Co. - Lima, Ohio:  On or about April 22, 2009,
the employer did
not ensure that the Budgit overhead hoist #637 (underhung on bottom
flange) had a functioning
safety latch on the hook.  The load and/or lifting devices could be
dislodged from the hook as
employees used the hoist to lift product/calendar rolls into the Fischer
#2 machine, exposing
employees to crush injuries.
Among other methods, one feasible and acceptable method to correct this
hazard is to
follow ASME B30.10-2003: Overhead Hoists (Underhung).
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
