Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a lack of temporary traffic control devices conspicuously placed to alert, channel, and protect against approaching vehicular traffic: a) Construction Site, Rt. 18 and Hall Ave., Lake City, PA - On or about 6/1/10, Employees were performing work operations in and around an excavation that was 5-feet 5-inches deep. Excavation was located next to the a travel lane of Route 18. Only four (4) drums had been placed at each corner of the excavation. Personnel were not protected by any additional devices/methods (e.g. taper comprised of channelizing devices and/or Truck Mounted Attenuator).
