Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to the hazard of puncture wounds from pneumatic staplers:
a)   Tharp Cabinet Corporation, 1246 North Denver Avenue, Loveland, CO:
The employer had not ensured that the Senco brand pneumatic staplers were
operated with all factory equipped safety devices. Throughout the facility
numerous pneumatic staplers were operating with the "contact safety
element"
removed. Removal of the safety element allow the firing of fasteners
without first
making contact between the material to be fastened and the discharge tip
on the
stapler.
Among other methods, one feasible and acceptable abatement method to
correct
this hazard is to follow the manufacturers safety instructions found in
pamphlet
#SFTY010. Page 4 states "Never use tool if safety element, trigger or
springs
have become inoperable, missing or damaged. Do not tamper with or remove
safety element, trigger, or springs."
