29 CFR 1910.132(d)(1): The employer shall assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE). (a) Tharp Cabinet Corporation at 1246 N. Denver, Ave. in Loveland, CO: The employer did not assess the workplace to determine if hazards were present, or were likely to be present, which necessitated the use of personal protective equipment in that Finishing tasks involving chemical, physical, or other hazards were not assessed to determine PPE requirements. Lack of a PPE Hazard assessment may prevent employees from choosing and using the correct PPE for a task. Abatement Note: If such hazards are present, or likely to be present, the employer shall: Select, and have each affected employee use, the types of PPE that will protect the affected employee from the hazards identified in the hazard assessment; Communicate selection decisions to each affected employee; and, Select PPE that properly fits each affected employee. Note: Non-mandatory Appendix B contains an example of procedures that would comply with the requirement for a hazard assessment. 29 CFR 1910.134(e)(1) The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:: (a) Tharp Cabinet Corporation at 1246 N. Denver Ave. in Loveland, CO: The employer did not provide medical evaluations to determine each employee's ability to use a respirator, before the employee was fit tested or required to use a respirator in the workplace. This condition may allow employees with pre-existing medical conditions to use respirators when they are not physically capable of doing so. Abatement Note: When elastomeric or supplied-air respirators are worn voluntarily by workers (not required by you or OSHA), you must ensure that the workers are medically able to wear the respirators and that they are provided with the information in Appendix D to the standard. Using a respirator may place a physiological burden on employees that varies with the type of respirator worn, the job and workplace conditions in which the respirator is used, and the medical status of the employee. Abatement Note: Where respirator use is not required, the employer must ensure that any employee using a respirator voluntarily is medically able to use that respirator, and that the respirator is cleaned, sotred, and maintained so that its use does not present a health hazard to the user (1910.134(c)(2)(ii). Denver Ave. in Loveland, CO: On and before August 28, 2012 suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate use in that the maintenance manager adds water to the forklift batteries outside and the nearest eyewash is inside near the spray area. This condition exposed the maintenance manager to an eye hazard. Abatement Note: According to Z358.1, eye wash stations shall be located in an area that requires no more than 10 seconds to reach.
