North Carolina:  The employer did not furnish each of his employees
conditions of
employment free of recognized hazards that were causing or likely to cause
death or
serious physical harm to employees in that employees were exposed to a
being struck by
or crushed by a powered industrial truck in the event of an upset:
a)establishment - a Toyota forklift was not equipped with a seatbelt.  An
employee
was observed operating the forklift without a seatbelt which could result
in the
employee being thrown from the lift truck in the event of a vehicular
accident.
Abatement Note:  One feasible and acceptable abatement method to correct
this hazard
is to retrofit the forklift with a seatbelt.  Forklift training must also
be provided for the
employees; then enforcement of a disciplinary policy requiring employees
to use the
seatbelt when operating the lift.ting
