Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and/or crushed by hazards: a)San Manuel Parking Structure: A John Deere 710G backhoe Company Number 214 had bolts and nuts, that did not meet the original equipment manufacture's specification to the attach the Jackhammer. AMOUNT OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THE HAZARD: 1.To follow the American Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts are replaced and, 2.To follow the Manufacturer's Operator Manual by using the only service parts meeting manufacturer specifications, and 3.To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs before equipment is placed back in service.
