Section 5(a)(1) of the Occupational safety and Health Act of 1970: the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: a. On or about February 13, 2009 - at the above addressed jobsite, employees performing siding operations from a platform on the forks of a Terex Square Shooter Model Number SS 636, rough terrain forklift truck were exposed to fall hazards in that an operator was not present to operate the controls and/or the platform was not equipped with controls. One feasible and acceptable abatement method, among others, would be to comply with the ASME/ANSI B56.6- 2002 Safety Standard for Rough Terrain forklift trucks, which requires a trained operator to be in position to control the rough terrain fork truck.
