29 CFR 1910.178(l)(1)(ii): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a   powered industrial truck safely:    a.  On or about August 16, 2018, at the above address, an employee was required to operate a powered industrial vehicle and had not been provided with training, including but not limited to formal instruction, practical training and an evaluation of the operators performance, thereby exposing employees to struck by and crushing hazards.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.    a. On or about August 16, 2018 at the above addressed jobsite, an employee performing window installation operations from a job made box on a PIV, approximately twelve (12) feet to thirteen (13) feet above the ground, was exposed to injuries from falls due to the lack of guardrails.

29 CFR 1926.602(c)(1)(ii): Modifications or additions affecting the safe operation of the equipment were  made without the manufacturer's written approval: Note:  If such modifications or changes were made, the capacity, operation, and maintenance instruction plates, tags, or decals should have been changed accordingly.  a.  On or about August 16, 2018, at the above addressed jobsite, an employee was using an unapproved attachment (a wooden job made box) on the forks of a power industrial vehicle (PIV TEREX SS-636 Turbo forklift) to hoist an employee that was installing windows, thereby exposing the employee to fall and struck by hazards.
