Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer failed to provide a place of employment which was free from recognized hazards that were likely to cause death or serious physical harm to employees: a. On or about August 5, 2009, at the above addressed jobsite, an employee was raised and lowered into a 30 foot deep trench excavation via a personnel platform which was suspended by a John Deere 750 excavator. A feasible means of abatement would be the use of a crane which meets the requirements of 1926.550(g) or the use of a ladder.
