General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a)At the project, slightly bent pieces of rebar were used instead of the manufacturer's pins or equivalent to secure couplings that held the bucket on a Caterpillar backhoe, model number, 426, Series II, exposing employees to the hazard of being struck by the bucket in the event the bucket separated from the backhoe. Among other methods, one feasible and acceptable method to abate this hazards is to: 1. To follow the Association of Equipment Manufacturers (AEM) "Safety Manual for Operating and Maintenance Personnel" which requires that damaged and missing parts be repaired or replaced, and 2. To follow the Manufacturer's Operator's Manual by using only service parts meeting the manufacturer specifications and 3. To train operators and maintenance personnel to inspect equipment for defects and to complete service and repairs for equipment is returned to service.
