Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards of thermal burns from water with temperatures of approximately 170 degrees farenheit while working near and around the ECU boiler Blow-Down condensate sump. Employees were not warned of the hazards of the high temperature water contained in the pit due to the lack of a "danger" sign being posted at or near the hazard to alert the employees of the high temperature water. One feasible and acceptable method, among others, to correct this hazard would be to comply with American National Standards Institute (ANSI) Z35.1-1972, Specifications for Accident Prevention Signs, page 10, paragraph 7.1 which states,"Signs shall be so placed to alert and inform in sufficient time to avoid the hazard or take appropriate action."
