Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free of recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while using improperly maintained mobile ladder stands. a) Maintenance Garage - On or about March 4, 2009, employees were using a 4 riser mobile ladder stand with missing and damaged parts exposing employees to potential injury from falling 3'3" above grade. b) Maintenance Garage - On or about March 4, 2009, employees were using a 12 riser mobile ladder stand with missing and damaged parts exposing employees to potential injury from falling 9'6" above grade. ABATEMENT NOTE: Among outher methods, one feasible and acceptable abatement method to correct this hazard is: Comply with the manufacturer's requirements and ANSI A14.7-1991 for Mobile Ladder Stands and Mobile Ladder Stand Platforms. Section 6.3 requires: "Units that are damaged or weakened from any cause shall not be used until repairs are completed. Units that are damaged subsequent to their receipt, and/or are worn beyond repair shall be destroyed. Never climb a damaged ladder stand or ladder." No abatement certification or documentation required.tion
