Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard fires and explosions: (a)On or about April 7, 2009 - Bay # 3 and Bay # 2, diesel fuel loaders were operated in areas that contained combustible dust and were not equipped with safety devices designed to reduce the fire and explosion hazards. Among other methods, one feasible and acceptable method to correct this hazard is to provide spark arresters on the exhaust stacks of all diesel-powered units in accordance with the National Fire Protection Association (NFPA) 61, Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities - 2008, Chapter 13, Section 13.5.2, Engine and Motor-Driven Equipment.
