Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and/or explosion hazard while placing or removing pyrotechnic compositions into or out of a drying building that was not grounded to eliminate or minimize static charges: (a)On or about 06/23/09 - Building AT2, pyrotechnic composition production and pressing area, building AT2, the employer did not ensure that a building used for drying pyrotechnic compounds was properly grounded to prevent static discharge. (b)On or about 06/2309 - Building AT6, building used for drying nitrocellulose mixtures was not grounded to prevent or eliminate static charges. (c)On or about 06/23/09 - Warehouse storage Building A3, magnesium and other combustible metals, such as aluminum were stored in close proximity to other combustible compounds and materials. (d)On or about 06/23/09 - Warehouse storage Building A2 (Fuel Storage Room), magnesium and other combustible metals, such as aluminum were stored in close proximity to other pyrotechnic compounds. Among other methods, one feasible and acceptable method to correct instance (a) and (b) would be to comply with the requirements for static dissipation outlined in NFPA 77 -2007, Section 7.4 "Charge Dissipation". To comply with instance (c) and (d) would be to comply with the requirements for storing combustible metal powders contained in NFPA 484-2009 edition, Section 7.7.6.3.
