OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to explosion and fire hazards:  (a) On or about 11/21/13 - in the C3 Process Building, the employer allowed research and development work to be conducted in the same process building where manufacturing work was being conducted instead of in a pyrotechnic laboratory. The employer's maximum quantity limitations allowed 20-lbs of pyrotechnic composition in the C3 Process building.

(b) On or about 12/11/13 - at C12 Processing Building, the plastic waste receptacle used in a location classified as Class II, Division 1 and where employees were assembling pyrotechnic articles was not approved and equipped with a cover as per NFPA 495-2006, section 5.2.5.

(b) On or about 12/11/13 - at Processing Building C2, the ITW Dynatec Hand Applicator did not have markings to show its suitability for use in the building C2 that was classified as Class II, Division 1.  (c) On or about 12/11/13 - at Processing Building C12 , the ITW Dynatec Hand Applicator did not have markings to show its suitability for use in the building C12 that was classified as Class II, Division 1.  Ultratec Speical Effects, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 313086266, citation number 01, item number 017 and was affirmed as a final order on 10/26/09, with respect to a workplace located at 148 Moon Drive, Owens Cross Roads, Al 35763.

(b) On or about 12/11/13 - at A4 Mixing building, portable electrical and electronic equipment such as but not limited to the 2-way radios were allowed in the processing area and were not included as being permissible to the area in the written standard operating procedures such as but not limited to Preparing Ammonium Perchlorate Based Starmines  and Preparing Nitrocellulose Based Starmines.
