Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about July 24, 2009, and times prior to, with respect to the multi-story building being constructed at or near 12 Crossing Court, Little Rock, Arkansas. Two employees of CBM Construction Company, Inc., were operating a rough terrain forklift without having their seatbelts fastened. They were exposed to the hazard of being crushed by the (ROPS) roll over protection system of the rough terrain forklift should it tip or roll over and eject the employee. One feasible means of abatement would be to have all rough terrain forklift operators read the operators manual prior to operation to be aware of the warnings and safety features, and to wear the manufacturer provided seatbelt when operating the vehicle.g
