SCRR 71-112A: Failed to furnish a place of employment which is free of recognized hazards which may cause death or serious physical harm to his employees and comply with this regulation and other occupational safety and health rules and regulations promulgated under Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as amended,0 as follows: A. Employer knew or should have known that employee operating a JLG forklift, model 844418, equipped with a roll over protection system, without wearing the seat belt was exposed to the hazard of being thrown from the forklift at the Morningstar Mini Storage job site. A feasible and useful method, among others, to correct this hazard is to ensure employees wear the seat belt when operating the forklift.

Employer knew or should have known that operating a JLG forklift, model 844418, with inoperative reverse signal alarm, or observer used constituted a hazard of employees being struck by the forklift when it is being operated in reverse gear at the Morningstar Mini Storage job site. A feasible and useful method, among others, to correct this hazard is to require reverse signal alarm.
