Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to dust explosion, deflagration, or other fire
hazards from process
equipment that was not protected by proper venting, inerting, or
containment, or suppression
systems:
1)  ADM Grain Company, 1301 Miami Street, Ohio:  On or about November 15,
2010, the employer did not ensure that the process equipment used to
handle, store,
and convey grains was protected with deflagration controls.  Equipment
requiring
protection included, but is not limited to, enclosed conveyors,
distributors, and
was explosive and a Class II material.  Employees were at risk of serious
injury from
explosion and fire hazards.
Among other methods, a feasible abatement method to correct this hazard
is: install
engineering controls such as explosion venting, suppression, or
containment in accordance
with the requirements of NFPA 61-2008, Standard for the Prevention of
Fires and Dust
Explosions in Agricultural and Food Processing Facilities, section 6.3.1.,
NFPA 654-2006,
Standard for the Prevention of Fire and Dust Explosions from the
Manufacturing,
Processing, and Handling of Combustible Particulate Solids, section 7.1.2,
and/or NFPA 69-
2008, Standard on Explosion Prevention Systems, chapter 11.
In accordance with 29 CFR 1903.19(d), abatement certification is required
for this violation (
using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include, but is not limited to,
evidence of the
purchase or repair of the equipment, photographic or video evidence, or
written records.
