were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to struck-by hazards:
(a)On or about November 16, 2009 - Yard, an employee was operating a
forklift without
utilizing the restraint device.
Among other methods, one feasible and acceptable method to correct this
hazard is would be to
ensure that all forklift drivers utilize the restraint devices provided on
the forklifts.
