Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: a)CM Front Autobrusher - On October 20, 2009 two employees were exposed to struck by hazards from a Dong Sung Industry pneumatic hoist rail system which was not load rated nor the load marked on the crane. Among other methods one feasible and acceptable method to correct this hazard is to load rate and marked the crane rated load in accordance with the American Society of Mechanical Engineers Safety Standard for Cableways, Cranes, Derricks, Hoist, Hooks, Jacks, and Slings; American Society of Mechanical Engineers National Standard ASME B30.11-2004 paragraph 11-1.1.1 b)CM Front Autobrusher - On October 20, 2009 two employees were exposed to struck by hazards from a Dong Sung Industry pneumatic hoist rail system which was not inspected by a qualified person prior to being placed into service. Among other methods one feasible and acceptable method to correct this hazard is to load rate and marked the crane rated load in accordance with the American Society of Mechanical Engineers Safety Standard for Cableways, Cranes, Derricks, Hoist, Hooks, Jacks, and Slings; American Society of Mechanical Engineers National Standard, ASME B30.11-2004 paragraph 11-2.1.1. c)CM Front Autobrusher - On October 20, 2009 two employees were exposed to struck by hazards from a Dong Sung Industry pneumatic hoist rail system when the crane operator was not instructed in the operation to be performed. The operator was not instructed to verify the operation of the upper-limit device under normal load conditions. Among other methods one feasible and acceptable method to correct this hazard is to instruct the operator on the warning signs on the hoist, the operation instructions in the operators manual and the hoisting practices listed in the load rate and marked the crane rated load in accordance with the American Society of Mechanical Engineers Safety Standard for Cableways, Cranes, Derricks, Hoist, Hooks, Jacks, and Slings; American Society of Mechanical Engineers National Standard ASME B30.16-2007 paragraph 16- 3.1.1 and paragraph 16-3.1.5.
