Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a)On or about 12/23/09 - 22nd Street North, Birmingham, AL, employees cleaning exterior windows utilizing a Rope Descent System (RDS) were not protected from falling in that the employees did not wear and safely secure their personal fall arrest equipment prior to approaching the point of suspension, employees were not trained in the proper method of equipment set-up, there was no provision for prompt rescue in the event of an emergency, and the wheels of the single-point scaffolding where resting on the parapet. Among other methods, one feasible and acceptable method to correct this hazard is to follow the guidelines of the American National Standards Institute/International Window Cleaning Association, ANSI/IWCA I 14.1-2001, Section 5.7, Rope Descent Systems (RDS).
