P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to fall hazard(s):
a)Westside of building at the construction area, on or about September 16,
2010,
an employee dismantling scaffold planks was observed standing on scaffold
planks, which were elevated and supported by forks attached to a GENIE
Telescopic Load-All, Model GTH-644 GENIE, and exposed the employee to a
fall hazard up to 28 feet.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS: Ensure operator and employees adhere to
manufactures
instructions found in the operator's manual, for a GENIE Telescopic
Load-All, Model
GTH-644 GENIE, that stated never use the machine as a platform for lifting
and
supporting people.
