P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being struck by falling concrete blocks: A) Welding shop area, on or about November 16, 2010, A walk through opening in a brick wall did not have any means of supporting the blocks above the opening or blocks that were only partially supported, exposing employees to a hazard of being struck by falling blocks. A feasible and acceptable abatement method to correct the hazard is to have an engineer design the opening in the block wall or properly close-up the wall opening. ABATEMENT CERTIFICATION IS NOT REQUIRED.
