Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to amputation hazards created by the operation of band saws which were not protected by emergency stop buttons. a) Plant - On or about 03/15/11, employees operated the four horizontal band saws for dissasembling pallets. The emergency stop buttons mounted on top of the service disconnect boxes were not operating. Abatement method: Among other methods, a feasible and acceptable abatement method to correct this hazard is to install emergency stop buttons that meet the requirements of the National Fire Protection Association (NFPA) 79 Section 13.2 Electrical Standard for Industrial Machinery, Emergency Stop Devices. 1) You are not limited to the abatement methods suggested above. 2) The methods explained are general and may not be effective in all cases. 3) The employer is responsible for selecting and carrying out an appropriate method. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
