29 CFR 1910.28(b)(1)(i): Each employee on a walking/working surface having an unprotected side or edge which was four feet (1.2m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about April 16, 2019 employees were exposed to fall hazards from heights up to 4 feet, 2.5 inches where the employer provided a refrigerator for employee use and employees maintained an improvised break area adjacent to shipping dock doors on the north side of the production area near the trim saw station and the employer did not provide fall protection meeting the requirements of this standard.

29 CFR 1910.132(d)(2): The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed: On or about April 16, 2019 where employees were exposed to hazards including, but not limited to, noise, flying particles from saw operations, and splintered wood which required the use of personal protective equipment; the employer had not verified that the required workplace hazard assessment had been completed through a written certification that identified the workplace being evaluated, the person performing the hazard assessment, the date of the hazard assessment and which identified itself as a certification of hazard assessment.
