Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)On or about 6/15/10 in the packaging area, retail #1 box machine: An employee cleaning the retail #1 box machine from an eight foot fiberglass step ladder was observed working from between the second and third step facing away from the ladder as a high pressure water hose was used to clean the machine. The employee was exposed to falling off the ladder toward the machine and onto the concrete floor due to not being centered over the ladder. Among other methods, one feasible and acceptable method to correct this hazard would be to ensure employees face the ladder and are centered over the rungs during use.
