29 CFR 1910.119(e)(4): The process hazard analysis was not performed by a team with expertise in engineering and process operations: a. The Operations Superintendent did not attend and participate in the 2008 process hazard analysis meeting, but instead attended a budget meeting. The Risk Management Plan, Section 3, "Process Hazard Analysis," Jan. 2002, 3.4.1, "Staffing PHAs" states that "The Operations Superintendent will assemble a process hazard analysis team consisting of the following personnel:...Operations Superintendent." In addition, Section 1, "Management Systems," Table 1-1, states that the responsible employee for the Process Hazard Analysis is the Operations Superintendent, and Table 1-2, under employee involvement, lists the Operations Superintendent as a designated employee. (Note: The company had not met the requirement for updating the PHA; the last PHA was conducted in 2000.)ted

29 CFR 1910.119(l)(1): The employer did not establish and implement written procedures to manage changes to process chemicals, technology, equipment, and procedures; and, changes to facilities that affect a covered process: a. In the evaporator room, chlorine buidling, where the electrical power to the evaporator and vacuum regulator was changed, and a circuit breaker was added, the management of change procedure and form was not followed. b. During chlorine tank changing, a management of change procedure was not implemented for a change in respiratory protection, where the standby person was to be positioned, and what procedures were to be followed depending on conditions. Abatement certification and abatement documentation is required for this violation.
