Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of struck by from using a lifting device on a 2RII Packmaster waste disposal truck that did not have latches for the trunnion bar to secure the waste container to the waste disposal truck. (a) Location - Heritage Drive, Salem, MA: On or about 6/14/10, the employer failed to ensure that the latches on a 2RII Packmaster waste disposal truck were operatable.
