OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to struck-by and crush-by hazards:        Location: High Street, Beverly, MA  On or about 9/30/15, an employee was operating truck #308, Heil Durapack 4060 split body rear compacting unit and the employee's hand was caught and crushed between the downward motion of the hopper and the side of the compactor, amputating the right index finger to the third knuckle.    Among other methods, feasible and acceptable methods to correct this hazard is to:  1. Create and implement a stand-alone standard operating procedure (SOP) for employees operating the compactor controls on waste collection trucks.  2. Follow the requirements listed in ANSI Z245.1-2008, American National Standard Institute (ANSI) for Equipment Technology and Operations for Wastes and Recyclable Materials --- Mobile Wastes and Recyclable Materials Collection, Transportation, and Compaction Equipment - Safety Requirements;  a. In accordance with ANSI Z245.1-2008, section 6.2.5.3 Packing and material handling controls and section 9.3. Train and retrain employees on the operation of the compacting controls formally utilizing the manufacturers instructions and company specific procedures, with an emphasis that all persons keep clear of the hopper and/or lifting mechanism before actuating any packing cycle or material handling controls. The training shall include that operators remain at the controls during the packing cycle, ready to stop the packing cycle or material handling operation, necessary during the portion of the packing cycle, where there is a potential point of operation hazard. Perform retraining periodically as required per the requirements listed in ANSI Z245.1-2008, section 9.  b. In accordance with ANSI Z245.1-2008, section 9.2.1.(a) through (e);  i). Conduct a hazard assessment of the various types of collection and transportation equipment which the employer utilizes and the hazards associated with them;  ii). Conduct an evaluation of the means and methods of controlling the hazards identified in the hazard assessment.  iii). Create a written program, based upon the hazard assessment and evaluation, to include procedures for the operation, inspection, and maintenance of equipment, prohibited practices, recordkeeping, training requirements, and normative references to documents, such as operating manuals, that are relied upon and may be required as part of that program.  iv). Implement the program through employee training and retraining;  v). Periodic reviews and program revisions as necessary to ensure the effectiveness of the safety program.  c). In accordance with ANSI Z245.1-2008, Section 9.3.1.2 Instructions; Obtain and make readily available to employees a copy of the manufacturers instructions for the Heil Durapack 4060 split compactor unit.

Location: High Street, Beverly, MA  On or about 9/30/15, the employer did not report a right index finger amputation to OSHA within 24-hours.
