Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: a)Employee(s) were exposed to the hazard of falling while using a 10 foot fiberglass step ladder in folded state leaned against a structural steel piece under assembly with employees standing on the eighth rung exposed to a fall hazard of about 6 feet. Among other methods, a feasible and acceptable abatement in accordance with provisions stipulated in ANSI/A14.5-1992 for Ladders--Portable Reinforced Plastic, Paragraph 9.3.1. 9.3.2.1 as applicable. Essential Elements include, but are not limited to, the following: 1. Step ladders shall be used only in a fully-open position.2. Users shall climb or step no higher than the step or rung indicating the highest standing level on a stepladder. 3. The step ladder base shall be placed with a secure footing on a firm, level support surface. 4. Users shall ensure that the step ladder is fully opened, with spreaders locked, and all feet contacting a firm level support surface. No additional abatement information is required for this item.
