OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were allowed to operate powered industrial trucks (Yard Dogs) without seat belts installed and headache racks exposing employees to stuck-by and crushing hazards: a) At Qualico Steel Company, Webb, Alabama: On or about 9 November 2016 and at times prior; employees were exposed to struck by and crushing hazards in that seat belts were not installed on yard trucks # D3, D4 and #40 345.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: a) At S-20 Band Saw: On or about November 9, 2016 and at times prior; the employer exposed his employees caught-by hazard in that he allowed his employees to operate the band saw without ensuring the exposed portions of the blade were guarded.
