Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a crushing hazard:
a)On the south side of the north aisle of the manufacturing plant:  On
October 6,
2010 and at times prior to, the employer failed to insure that the lifting
device
was marked with its rated capacity, manufacturer information and serial
number
exposing employees to crushing hazards  from a falling load while lifting
400-800
pound hand rails during manufacture.
ABATEMENT NOTE: Among other methods, one feasible means of abatement would
be
contained in ASME B 30.20-2003 Below the Hook lifting Device in that the
company engineer
would determine the rated capacity and mark the information along with the
manufacturers name
and address, serial number, lifting device weight if over 100 lbs on the
device. The device must
also be inspected periodically, proof tested and certified.
