North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: a)HDPE reclaim box dump - the design of the ventilation hood was not effective in controlling the escape of fugitive combustible dust during normal operation. The hood was also bent and disconnected from the duct work leading to the dust collector. b)HDPE reprocessing - the HDPE board line waste generated during grinding operations dropped from a cyclone used as a primary separator into a gaylord type box and no methods were utilized to confine and control the escape of combustible dust into the surrounding environment. c)HDPE reprocessing - the HDPE trim waste generated from the HDPE board lines dropped into open-topped gaylord type boxes and no methods were utilized to confine and control the escape of combustible dust into the surrounding environment. d)HDPE extruder lines - the Brabender weigh scales and the design of the ventilation system (china hats) were not effective in controlling the escape of combustible dust to the surrounding environment. e)HDPE reclaim box dump - the Rees, model CX 1530-6, 15 HP, enclosureless dust collection system was located within 6 feet of the aisle (a means of egress), and in an area routinely occupied by employees. The dust collector was not emptied at least daily or more frequently as necessary. f)HDPE reprocessing - board line waste, the cyclone located inside the facility and used as a primary separator, did not contain explosion protection, such as but not limited to deflagration venting and isolation protection. g)outside HDPE reprocessing - the HDPE dust collection system, the process equipment such as the Aircon cyclonic baghouses did not contain explosion protection, such as isolation protection. h)storage silos - such as the PVC wood flour, HPDE wood flour and regrind silos, were not provided with explosion protection, such as isolation protection. Among other methods, feasible and acceptable methods to abate these hazards is to comply with National Fire Protection Agency (NFPA) 654, "Standard for the Prevention of Fires and Explosions from the Manufacturing, Processing and Handling of Combustible Particulate Solids" (2006) and/or National Fire Protection Agency (NFPA) 664, "Standard for the Prevention of Fires and Explosion in Wood Processing and Woodworking Facilities" (2007).Note: The design of fire and explosion safety provisions shall be based on a thorough process hazard analysis of the facility, the process and the associated fire and explosion hazards.
