Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to struck-by hazards from a ROPS installation on a D6K Caterpillar bulldozer and he was not protected by wearing a seatbelt. (a)Highway 84 East - On or about August 8, 2011 an employee was exposed to struck-by hazards while operating a D6K Caterpillar bulldozer to fill highway holes. The employee was not protected by wearing a seatbelt from being struck by the ROPS structure in the event of a rollover. Among other methods, one feasible and acceptable abatement method to correct this hazard would be to require employee to wear seatbelt.
