recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to crushing hazard:
a.On or about September 8, 2011, in the loading area, the Taylor forklift
did not
have a working seat belt, the seat belt was heavily corroded and buckled
up under
the seat, exposing employees to being crushed by overturned lifts.
b.On or about September 8, 2011, in the loading area, the Gradall forklift
did not
have a working seat belt, the seat belt was heavily corroded and could not
be
buckled together, exposing employees to being crushed by overturned lifts
c.On or about September 8, 2011, in the loading area, the Tico off road
yard
tractor did not have a working seat belt, the seat belt had been removed,
exposing
employees to being ejected from the machine and either crushed by or
struck by
the tractor.
Among the most feasible means of abatement include but are not limited to
the following:
1.Utilizing the seat belts in accordance with ASME/ANSI B56.1-1998,
paragraph
5.3.19 which provides in the part that, "an active operator protection
device or
system, when provided, shall be used".
2.Creating and enforcing a forklift safety program which ensures
protective devices
are used.

anyway unsafe had not
been withdrawn from service until restored to safe operating condition(s):
