29 CFR 1910.95(g)(5)(ii):"Mobile test van exception." Where mobile test vans are used to meet the audiometric testing obligation, the employer shall obtain a valid baseline audiogram within 1 year of an employee's first exposure at or above the action level. Where baseline audiograms are obtained more than 6 months after the employee's first exposure at or above the action level, employees shall wear hearing protectors for any period exceeding six months after first exposure until the baseline audiogram is obtained. a. A fabricator working in the fabrication bay was exposed to a noise dose of 78.9%, or an equivalent dBA of 88.3 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 363 minutes during one shift on June 28, 2023. The employer did not perform baseline audiograms for all employees working in the fabrication bay within one year of employees' date of hire. b. A fabricator working in the fabrication bay was exposed to a noise dose of 133.9%, or an equivalent dBA of 92.1 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 363 minutes during one shift on June 28, 2023. The employer did not perform baseline audiograms for all employees working in the fabrication bay within one year of employees' date of hire. c. A fabricator working in the fabrication bay was exposed to a noise dose of 109.0%, or an equivalent dBA of 90.6 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 385 minutes during one shift on June 28, 2023. The employer did not perform baseline audiograms for all employees working in the fabrication bay within one year of employees' date of hire. d. A fabricator working in the fabrication bay was exposed to a noise dose of 114.4%, or an equivalent dBA of 91.0 dBA, which was capable of causing permanent hearing loss. The sampling was performed for 363 minutes during one shift on June 28, 2023. The employer did not perform baseline audiograms for all employees working in the fabrication bay within one year of employees' date of hire.

The employer did not submit the information once a year, no later than the date listed in paragraph (c) of this section of the year after the calendar year covered by the form: a. Trinity Fabricators, Inc., located at 825 Corporate Square, Green Cove Springs, FL 32043: On or about March June 27, 2023, and times prior thereto, the employer failed for calendar year 2022, to electronically submit information from the OSHA Form 300A or equivalent by March 2, 2023. The establishment employed approximately 42 employees and was classified in the North American Industrial Classification System as 332312 during calendar year 2022.
