Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to crushing hazards: 1. At the establishment: On or about 4/13/2011 the employer did not ensure that an employee operating a Taylor,F3, 25,000 lbs load capacity, powered industrial truck fastened his seat belt. The employee was exposed to crushing hazard. Among other methods, one feasible and acceptable method to correct the hazard is to ensure that employees fasten their seat belts when operating powered industrial trucks in accordance with the manufacturer's instructions.
