Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to his employees in that employees were exposed to struck-by and crushing hazards: (a)On or about 08/31/2011 - the operator of the HDF 25-5 forklift was not using the seat belt. Among other methods, one feasible and acceptable method to correct this hazardous condition would be to require forklift drivers to utilize the restraint devices provided on forklifts in accordance with ASME B56.1-1993, Safety Standard for Low Lift and High Lift Trucks, Section 7.39, Operator Restraint Systems.
