OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that the employee was exposed to falling, crushing, and caught-in hazards when being lowered into a trench in the bucket of an excavator:    a) Jobsite: On May 25, 2011 the bucket of a Volvo 235 excavator was used to lower an employee into an unprotected area of an approximate 19 foot deep, nearly vertical walled excavation to perform sewer line installation activities.  This exposed the employee to the hazards of falling approximately 19 feet, to being struck by the bucket, and being caught in-between moving parts of the excavator bucket.     Note 1) Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow SAE J153, Surface Vehicle Recommended Practice, Section 4.3 Operator-General Precautions, instructs operators: "Do not permit riders on the machine if there is no manufacturer's designated place for a rider."     Note 2) Abatement certification and documentation are NOT required for this item.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    a) Jobsite: On May 25, 2011 a ladder was not in place to provide an employee working in an approximate 19 foot deep excavation, a safe means to enter or egress the excavation. 29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder:    a) Jobsite: On May 25, 2011 an extension ladder that was hung on brackets inside of the trench box during the inspection, which allowed an employee to egress the excavation, was positioned at a 90 degree angle. 29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations.  Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) Jobsite: On May 25, 2011 an employee performing sewer installation activities in an approximate 19 foot deep, nearly vertical walled excavation was exposed to the hazards of being struck-by falling materials or being caught by a cave-in of the wall and materials where the spoil pile was not placed back at least two feet from the edge of the excavation.      Note 1) Edstrom Construction, Inc was previously cited for a violation of this Occupational Safety and Health Standard which was contained in OSHA inspection number 311576409, citation number 1, item number 3, and was affirmed as a final order on June 20, 20008 with respect to the workplace at Main Street and Highway 20 East, Sugar City, ID 83448.     Note 2) Abatement certification and documentation ARE required for this item.
