29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions.  Inspections were not conducted by the competent person prior to the start of work and as needed throughout the shift.  a) On or about August 3, 2016 and at times prior thereto, the employer did not ensure a "competent person" inspected trenches and excavations prior to the start of work and as needed throughout the shift.  Employees were working to install a water line in an excavation at a depth ranging from 4 feet (1.22 m) up to 6.5 feet (1.96 m).  Employees did not have the protection of sloping, benching and/or other engineering controls such as an appropriate trench box throughout most of the water line installation and/or have a ladder on the job site for proper ingress/egress.   Abatement certification IS required for this item.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  a) Jobsite: On or about August 3, 2016, and at times prior thereto, the employer did not ensure the use of an appropriate ladder and/or other safe means of egress while employees were working to install a water line in a trench at a depth ranging from 4 feet (1.22 m) up to 6.5 feet (1.96 m).   Note 1) Abatement certification and documentation ARE required for this item.  Note 2) Edstrom Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(c)(2), which was contained in OSHA inspection number 63042, citation number 1, item number 1b and was affirmed as a final order on July, 6,2011, with respect to a workplace located at Yellowstone Hwy and 7th South, Rexburg, Idaho 83441.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations.  Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) Jobsite: On or about August 3, 2016, an employee performing water line upgrade activities in an approximate 4 feet (1.22 m) up to 6.5 feet (1.96 m), nearly vertical walled excavation was exposed to the hazards of being struck-by falling materials or being caught by a cave-in of the wall and materials where the spoil pile was not placed back at least two feet from the edge of the excavation.      Note 1) Edstrom Construction, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(j)(2), which was contained in OSHA inspection number 63042, citation number 2, item number 2 and was affirmed as a final order on July, 6,2011, with respect to a workplace located at Yellowstone Hwy and 7th South, Rexburg, Idaho 83441. Employees were working to install a water line in a trench at a depth ranging from 4 feet (1.22 m) up to 6.5 feet (1.96 m) with nearly vertical walls.
